2. Aspetti legislativi e ripercussioni sul minore

- la divulgazione di statistiche fa sentire il deviante (in questo caso il vero genitore maltrattante) come parte di una porzione significativa dell!
Bisogna invece evitare, in questa materia, di reificare delle metafore ritenendo che il "bambino alienato" abbia una sorta di malattia trasmessagli dal genitore e che, ogni qualvolta siano presenti critiche nei confronti di un genitore da parte del figlio, questi sia vittima della sindrome in questione.
3. Criteri per una diagnosi differenziale
Intanto è necessario stabilire che cosa non sia l'alienazione genitoriale: in tutte le famiglie, anche quelle intatte, si stabiliscono spesso delle alleanze talvolta spontanee, talvolta provocate ed in alcuni casi anche collusive (Willi, 1993) e spesso esistono delle preferences of the children to their parents even before the onset of marital conflict. - ritenere che un genitore sia soltanto vittima e l'altro soltanto colpevole o responsabile con una visione manichea e senza sfumature.
4. Fattori facilitanti lo sviluppo della sindrome
La diagnosi è complicata dal fatto che l'alienazione genitoriale può avvenire anche in assenza di un programma consapevole da parte del genitore che se ne avvantaggia. Inoltre le strategie che possono essere messe in opera per indottrinare e istigare il figlio contro l'altro genitore possono essere dirette e indirette : entrambe ruotano attorno ad un tema principale ("Tuo padre ci ha fatto mancare il sostegno economico") con ramificazioni e ampliamenti generalizzanti ("È un buono a nulla come suo padre"), ma non sono spesso immediatamente riconoscibili.
Delle strategie dirette è più facile trovare traccia perché possono essere scoperte vagliando in filigrana il comportamento del figlio che ricalca le opinioni di un genitore a danno dell'altro in assenza di assorbimento delle ragioni espresse da quest'ultimo. In alcuni casi è poi possibile scoprire con quali minacce, promesse, premi si è guadagnata l'opinione del figlio.
Le tecniche indirette, invece, incidono più sottilmente sull'opinione e sul comportamento dei figli. Esse di solito consistono nel far leva sulle emozioni del bambino, sul suo senso di lealtà. Stratagemmi di questo tipo possono essere di varia natura e la letteratura psicosociale è piena di indicazioni su tecniche più o meno esplicite di influenza interpersonale (Gulotta, 1995; 1989). Proviamo ad elencarne qualcuna (oltre a quelle indicate nella tabella):

Tra i professionisti della salute mentale, merita una specifica trattazione il ruolo dello psicoterapeuta dei figli, che può diventare parte del sistema che alimenta la PAS, in particolare quando le uniche persone con cui effettua i colloqui sono il genitore alienante ed il figlio. Questa situazione si realizza purtroppo di frequente, in quanto il genitore che sceglie lo psicoterapeuta per il figlio, lo accompagna per la seduta e si fa carico del pagamento, è nella posizione di influenzare lo psicoterapeuta in merito al ruolo che questi adotta, agli obiettivi della terapia ed agli eventuali terzi partecipanti. Lo psicoterapeuta si trova così a svolgere la terapia sulla base di informazioni incomplete o false, rinforzando l'idea che il bambino debba essere "salvato" dal genitore cattivo, in realtà il bersaglio dell'alienazione genitoriale (Lund, 1995).

Hernandez, 1988; Laos, 1988) has recently contributed to the approval of laws to tackle the problem of non-compliant fathers.
While the media rightly describe the difficulties caused to women and children by the phenomenon of non-compliant fathers, there was no talk of war waged by a separate group of mothers contro padri che pagano regolarmente l’assegno e rispettano la legge. In short, these cases do not correspond to the models of the PAS, however, indicate a serious abnormality.
The purpose of this study is to define and explain this anomaly more general with the hope of provoking a more thorough scientific analysis and clinical problem. Definition

This section provides an initial definition of the Malicious Mother Syndrome in a divorce that has been derived from clinical cases and legal proceedings. As with all initial proposals, it is hoped that future research will lead to greater refinement of the taxonomic criteria. The proposed definition encompasses four major patterns of behavior, as follows:
A mother who unjustifiably punishes her husband from whom she is divorcing or divorced:
attempting to alienate children from their father
involving others in malicious actions against his father by taking a
excessive litigation The mother specifically attempts to prevent:
the regular visits of children the father of the liberal
telephone conversations between the children and the father
the participation of fathers in school life and extracurricular activities of their children
The pattern is pervasive and includes malicious actions such as:
lie to lie to children
other violations of law
The disorder is not specifically due to another mental disorder, but may coexist with a more distinct mental disorder [clinical illustrations]. In this section I will give clinical examples of each point using the reference numbers used above.
Since the standard of behavior from 1 to 3 are specific to the Malicious Mother Syndrome in a divorce, I will give a series of clinical examples. The fourth point about the relationship of the syndrome in question with other mental disorders will be discussed in more general terms.
Model 1a: The alienation of the children

Modello 1c: Eccesso di azioni legali
È indubbio che entrambe le parti in causa nelle procedure per il divorzio o per l’affido hanno il diritto di presentare istanze o avviare azioni legali. Tuttavia alcune donne che soffrono della Sindrome della madre malevola nei casi di divorzio tentano di punire il marito con un eccesso di azioni legali.
Una madre bellicosa e irragionevole attaccava verbalmente il marito dovunque lo incontrasse. Col tempo la reazione di lui è stata quella di ignorarla. Allora lei ha portato il suo ex-marito davanti al giudice per obbligarlo a parlarle.

Model 3A: Malicious Lying to the children
Given their developmental status, children in a divorce situation are quite vulnerable to conflict. When a parent decides to harm another by lying to children, there may be cases of malicious behavior such as:

Model 4: Behavior is not caused by another disorder

Other cases might suggest as a possible diagnosis personality disorder, but there is a case of a woman who has repeatedly violated the law by continuing attacks against her husband and against which high-level specialists have never found personality disorders. In some cases you might want to consider the diagnosis of intermittent explosive disorder, but some mothers anger appears intermittently.
Finally, the reader should realize that one side is not always diagnostic accuracy for certain psychiatric disorders is to be expected (eg. The previous description of the Malicious Mother Syndrome in a divorce raises a variety of clinical problems, legal and scientific issues. Under the clinical aspect
families in which the syndrome manifests itself are subject to serious episodes of stress and anxiety. However, there is no scientific clarity on how to cure the problem. This is particularly compromised by the fact that many of those who appear to meet proposed diagnostic deny that there is something wrong with them. Another

Origini del nome

e irragionevole attaccava verbalmente il marito dovunque lo
incontrasse. Col tempo la reazione di lui è stata quella di ignorarla.
Allora lei ha portato il suo ex-marito davanti al giudice per
obbligarlo a parlarle". In questo modello la madre malevola tenta
di punire il marito con un eccesso di azioni legali.
2. la madre che tenta semplicemente di impedire:
a) Le visite regolari dei figli al padre: es. "una madre, che in
precedenza aveva aggredito fisicamente il marito quando questa
andava a prendere i figli, gli ha impedito di prenderli con sé anche
quando si è presentato con la polizia".
b) Le libere conversazioni telefoniche tra i figli e il padre: es. "ad un
padre che telefonava per parlare con i figli è stato detto che essi
non erano in casa, mentre lui sentiva in sottofondo le loro voci".
Nei casi in cui il genitore non può essere presente fisicamente, il
telefono è uno strumento utile per far mantenere il legame con i
figli. Quando a questi padri viene impedito anche il rapporto
telefonico, spesso alla fine smettono di telefonare ai propri figli e
così la madre malevola ha raggiunto il suo risultato.
c) La partecipazione del padre alla vita scolastica e alle attività
extracurricolari dei figli: es. "ad a father have been given the date and time

non hanno mai avuto riscontro di ciò pur riscontrando il permanere di certi
comportamenti anomali.
Ovviamente la descrizione dei casi fatti da Turkat solleva diversi problemi
dal punto di vista clinico e legale. Infatti va sottolineato che le famiglie in cui si
presentano questi avvenimenti sono soggette a gravi episodi di stress e angoscia.

Questo tipo di intervento va effettuato soprattutto in quei casi in cui il bambino deve recuperare il rapporto con un genitore o quando i genitori devono essere aiutati ad acquisire una loro competenza genitoriale.

Answer Dear Mara, the syndrome di Munchausen per procura è chiaramente una manifestazione di un sistema familiare patologico al cui interno le dinamiche intersoggettive hanno una connotazione di invischiamento ossessivo. In altre parole, sono d'accordo con Te nell'ipotizzare che dietro questa sindrome non ci sia odio nei confronti del bambino, ma piuttosto una sorta di amore patologico, non tanto per il bambino in se, ma per la situazione che esso con la sua “presenza” genera. A differenza di Te, non cedo che si tratti di voler controllare il bambino direttamente ma, come ho accennato prima, la situazione. Creo che sia possibile e utile, per la nostra comprensione, analizzare questa terribile sindrome attraverso i dettami della Terapia Sistemica. Ieri sera nella puntata del seguitissimo Dr House Medical Division si è parlato della Sindrome di Munchausen: una paziente si iniettava volutamente un farmaco che simulasse l'alterazione dei valori del sangue oltre a procurarsi dei lividi sul corpo.La sindrome è fra le patologie psichiatriche più complesse e assurde e spesso sfiora il franco comportamento criminale.Munchausen è il nome di un barone realmente esistito (1720-1797), che combatté a fianco dei Russi contro i Turchi e, una volta ritiratosi nel suo castello, si rese protagonista di racconti completamente inventati, e francamente surreali, sulle sue gesta, attribuendosi prodezze e atti eroici mai compiuti. L’espressione "Sindrome di Munchausen" fu invece utilizzata clinicamente per la prima volta da R. L’esame dei casi riportati in letteratura evidenzia da una parte la scarsa conoscenza dell’argomento da parte dei sanitari e la conseguente difficoltà di diagnosi, dall’altra una ulteriore difficoltà ovvero l’inquadramento in termini psichiatrici o meno del comportamento della madre, dal momento che tale sindrome appartiene certamente al sapere clinico.
Gli Autori, infine, evidenziano la necessità di una maggiore attenzione verso i bisogni formativi espressi dai soggetti che a vario titolo e per loro stesso mestiere sono coinvolti.

1. INQUADRAMENTO TEORICO DEL PROBLEMA
La Sindrome di Munchausen per procura è always been studied

spesso la madre, che sottopone il figlio o i figli a lunghe e rischiose analisi o ad
accertamenti diagnostici, a volte, decisamente invasivi per l’accertamento della

Meadow fornisce una lettura dei casi assai interessante offrendo una serie di
utili indicazioni sulle caratteristiche comportamentali che tipicizzano l’autore della
SMP riscontrabili poi, nella letteratura medica successiva, quali atteggiamenti di
collaborazione con il personale medico durante la degenza dei figli, dimostrazione

7) fabbricazione di disordini psichiatrici: riguardo questo metodo in letteratura
sono riportati casi nei quali le madri hanno fatto ricoverare i figli in unità psichiatriche
riferendo storie di allucinazioni e comportamenti bizzarri di interesse
psichiatrico[16];
8) problemi fittizi in gravidanza: questo metodo comprende travagli simulati,
sanguinamenti inventati, maltrattamenti al feto;
9) fortificazione dei sintomi alla presenza di una malattia fisica vera: tale metodo
viene considerato come una variante di SMP e si caratterizza per l’esaltazione
dei sintomi di una malattia vera e propria fino a renderli esagerati.
Molti studi concentrano i loro sforzi sull’individuazione dei comportamenti
dei protagonisti attivi della SMP, comportamenti in presenza dei quali nei sanitari
dovrebbe sorgere il sospetto di trovarsi di fronte a tale sindrome; Agosti,
Gentilomo, Merzagora[17] combinando i criteri di Eminson e Postlethwaite, di
Meadow, di Rosen et al. hanno tentato la sintesi di tutta una serie di situazioni la
cui presenza dovrebbe far nascere, appunto, almeno il “dubbio” di un caso di SMP:
- segni e sintomi bizzarri, che non si trovano in alcuna malattia conosciuta o che
sono incongrui rispetto a quadri patologici noti, difficilmente verificabili e in
numero eccessivo (più di cinque ma anche più di dieci sintomi diversi);
- il trattamento non ha alcuna efficacia;
- segni e sintomi compaiono solo quando i genitori (per lo più la madre) sono soli
con il bambino;
- il genitore ha o esibisce qualche conoscenza di medicina;
- il genitore ha un comportamento troppo controllato rispetto alla gravità dei problemi
del bambino ovvero, secondo Eminson e Postlethwaite[18], è la continua
ricerca di aiuto medico nonostante le rassicurazioni dello staff medico che deve
mettere in sospetto;
- il genitore stabilisce relazioni fin troppo strette e cordiali con i membri dello
staff ospedaliero;
- il genitore non lascia mai il figlio da solo durante la degenza;
- vi sono precedenti di malattie insolite o di morti strane nei fratelli o comunque
in famiglia.
E’ intenso lo sforzo da parte della letteratura scientifica di individuare indicatori
diagnostici delle situazioni munchausiane; oltre ai comportamenti sopra elencati
è facilmente individuabile un’altra caratteristica del genitore ovvero quella di
essere “itinerante sanitario”:egli inizia un percorso sanitario il cui scopo principale
è quello di evitare la relazione terapeutica con una sola struttura sanitaria e di
conseguenza cambiare più interlocutori sanitari; le “peregrinazioni” infatti sembrano
motivate dalla necessità, una volta che gli accertamenti hanno escluso patologie
vere e proprie oppure dopo che gli interventi chirurgici hanno esaurito richieste
e risposte terapeutiche, di andare alla ricerca di un ambiente nuovo nel quale
poter recuperare ex novo la credibilità di paziente[19]. Quanto alle conseguenze
prodotte sulle vittime, esse possono essere molteplici; il ricorso continuo ad accertamenti
diagnostici talvolta molto invasivi, a cure di qualunque natura, ad inter-

venti chirurgici come anche la somministrazione di sostanze dannose come sopra
detto, possono certamente procurare danni fisici fino naturalmente alla morte; non
vanno però tralasciate le conseguenze di natura psicologica di tale maltrattamento
verificabili anche a lungo termine. Come ben evidenziato da Merzagora
Betsos[20], nei bambini vittime della sindrome si possono presentare anche dopo
alcuni anni dai fatti problemi quali serie difficoltà di apprendimento e di concentrazione,
problemi comportamentali a scuola e in casa, problemi a livello emotivo,
incubi notturni, sindrome ipercinetica, sintomi propri del Disturbo Post-traumatico
da stress; si riscontrano inoltre, immaturità, relazioni simbiotiche con le madri,
aggressività. Infine, especially if the syndrome involves adolescents,

2. DESCRIZIONE DI UN CASO SOSPETTO DI SINDROME DI MUNCHAUSEN
PER PROCURA
Di seguito riportiamo un caso inquadrabile nell’ambito della SMP osservato nell’Unità Operativa di Pediatria del Policlinico Universitario “Le Scotte” di Siena.
I dati relativi sono stati raccolti attraverso la ricerca e la disamina dei vari documenti
reperibili e delle cartelle cliniche. S., la vittima, nata nel 1983 proviene da una regione del Sud-Italia. I genitori hanno un’età compresa tra i 35 e i 40 anni; la madre fa la casalinga e il padre di origine straniera fa l’impiegato. sempre maggiore, tumefazioni dolorose alle articolazioni delle mani, della caviglia e del ginocchio prima in concomitanza di piccoli traumi, successivamente senza che ve ne siano. In seguito a tali episodi S. viene più volte condotta al Pronto Soccorso dove le vengono applicati vari apparecchi gessati senza però alcun riscontro documentale. Nel maggio 1994 mentre la bambina gioca con un pallone si procura la lussazione dell’articolazione coxo-femorale destra; nei mesi successivi in assenza di episodi traumatici, la madre riferisce ai medici, senza produrre alcun referto a conferma, di numerose lussazioni riportate dalla bambina alla spalla sinistra. Nel luglio 1994 al risveglio, S. accusa un forte dolore al piede destro che appare tumefatto; una radiografia evidenzia una frattura di lieve entità, forse all’astragalo, in seguito alla quale si rende necessario l’uso di stampelle per la deambulazione. Nel dicembre 1994 la madre racconta di una tumefazione asintomatica bilaterale alle mani della durata di circa otto ore. 3. REFLECTIONS ON THE CASE

4. CONCLUSIONS

In letteratura[28] ritroviamo la descrizione di casi in alcuni dei quali si è fatto ricorso per le madri a trattamenti psicoterapici che però hanno avuto scarso successo nel senso di una mancata ammissione delle proprie responsabilità, in altri a terapie di tipo familiare.
Sono questi, a nostro parere, i casi in cui i due saperi, appunto, quello medico e quello giuridico stridono fortemente nella ricerca di una ermeneutica capace di soddisfarli entrambi e a ben riflettere il rischio è sempre quello di far valere l’uno a discapito dell’altro o di invocarne uno ancorchè l’altro.
Ci chiediamo a questo punto se nella descrizione di tale sindrome possiamo
definire i ruoli dell’autore e della vittima in maniera marcata o se, invece, ci troviamo
di fronte ad una sindrome con più vittime, ove l’autore è esso stesso doppiamente
vittima da un lato perché comunque il suo comportamento si declina in
circuiti diversi da quelli che naturalmente dovrebbero appartenere alla relazione
madre/figlio - qui svolta in termini distruttivi - e dall’altro however, because the behavior
