Chiedo a chi conosce più di me la legge: è legale da parte della giustizia "condannare" senza prove?



Vedete signori giudici, avvocati, legislatori credo sia facile occuparsi di pedofili, dei violentatori o di chi manifestatamene ed in modo eclatante produce danno.

Vi comprendo non è facile smascherare le sottili violenze psicologiche che si realizzano nel privato ma queste sono molto più frequenti delle altre.

È più facile difendere un'omicida o un ladro, è più facile condannarlo. Nessun avvocato si ritiene omicida o ladro, nessun giudice. Ma tutti hanno avuto madre e padre e molti sono padri e madri. Forse queste sentenze toccano corde personali.

Bisogna invece evitare, in questa materia, di reificare delle metafore ritenendo che il "bambino alienato" abbia una sorta di malattia trasmessagli dal genitore e che, ogni qualvolta siano presenti critiche nei confronti di un genitore da parte del figlio, questi sia vittima della sindrome in questione.

3. Criteri per una diagnosi differenziale

4. Fattori facilitanti lo sviluppo della sindrome
La diagnosi è complicata dal fatto che l'alienazione genitoriale può avvenire anche in assenza di un programma consapevole da parte del genitore che se ne avvantaggia. Inoltre le strategie che possono essere messe in opera per indottrinare e istigare il figlio contro l'altro genitore possono essere dirette e indirette : entrambe ruotano attorno ad un tema principale ("Tuo padre ci ha fatto mancare il sostegno economico") con ramificazioni e ampliamenti generalizzanti ("È un buono a nulla come suo padre"), ma non sono spesso immediatamente riconoscibili.

Stratagemmi di questo tipo possono essere di varia natura e la letteratura psicosociale è piena di indicazioni su tecniche più o meno esplicite di influenza interpersonale (Gulotta, 1995; 1989). Proviamo ad elencarne qualcuna (oltre a quelle indicate nella tabella):

Questa situazione si realizza purtroppo di frequente, in quanto il genitore che sceglie lo psicoterapeuta per il figlio, lo accompagna per la seduta e si fa carico del pagamento, è nella posizione di influenzare lo psicoterapeuta in merito al ruolo che questi adotta, agli obiettivi della terapia ed agli eventuali terzi partecipanti. Lo psicoterapeuta si trova così a svolgere la terapia sulla base di informazioni incomplete o false, rinforzando l'idea che il bambino debba essere "salvato" dal genitore cattivo, in realtà il bersaglio dell'alienazione genitoriale (Lund, 1995).

LA SINDROME DELLA MADRE MALEVOLA

Sommario
Con il crescere del numero dei divorzi che coinvolgono i bambini, è emerso uno schema di comportamento anomalo che ha suscitato scarsa attenzione. Il presente studio descrive la Sindrome della madre malevola nei casi di divorzio. Vengono dati degli specifici criteri nosologici con numerosi esempi clinici. Data la mancanza di dati scientifici disponibili sul disturbo, è necessario approfondire i problemi della classificazione, dell’eziologia, della cura e della prevenzione.

The media have made significant committed to increase public awareness about the problem of divorced fathers who do not provide for payment of maintenance set by the court. Hodges (1991) noted that three years after divorce, only 20% of divorced fathers involved in the payment of maintenance. The investigation leading to worsening economic conditions of women (see eg. Hernandez, 1988; Laos, 1988) has recently contributed to the approval of laws to tackle the problem of non-compliant fathers.
While the media rightly describe the difficulties caused to women and children by the phenomenon of non-compliant fathers, there was no talk of war waged by a separate group of mothers contro padri che pagano regolarmente l’assegno e rispettano la legge. The purpose of this study is to define and explain this anomaly more general with the hope of provoking a more thorough scientific analysis and clinical problem. Definition

This section provides an initial definition of the Malicious Mother Syndrome in a divorce that has been derived from clinical cases and legal proceedings. As with all initial proposals, it is hoped that future research will lead to greater refinement of the taxonomic criteria. The proposed definition encompasses four major patterns of behavior, as follows:
A mother who unjustifiably punishes her husband from whom she is divorcing or divorced:

The disorder is not specifically due to another mental disorder, but may coexist with a more distinct mental disorder [clinical illustrations]. In this section I will give clinical examples of each point using the reference numbers used above.

Model 1a: The alienation of the children

La persona “raggirata” assume un tipico atteggiamento di virtuosa indignazione che contribuisce a creare un’atmosfera gratificante per la madre che si appresta ad intraprendere azioni dolose.
Modello 1c: Eccesso di azioni legali
È indubbio che entrambe le parti in causa nelle procedure per il divorzio o per l’affido hanno il diritto di presentare istanze o avviare azioni legali. Tuttavia alcune donne che soffrono della Sindrome della madre malevola nei casi di divorzio tentano di punire il marito con un eccesso di azioni legali.
Una madre bellicosa e irragionevole attaccava verbalmente il marito dovunque lo incontrasse. Col tempo la reazione di lui è stata quella di ignorarla. Allora lei ha portato il suo ex-marito davanti al giudice per obbligarlo a parlarle.
Una madre ha detto al giudice che sua figlia non era figlia del marito.
Una donna si è rifiutata di rinunciare alle continue azioni legali contro l’ex-marito, malgrado numerosi avvocati avessero abbandonato il caso volontariamente o fossero stati licenziati. In tre anni si erano succeduti sette diversi avvocati.
Esistono dati che possono aiutare a determinare la gamma delle azioni legali. Per esempio Koel e altri (1988) riferiscono la frequenza di processi in un campione di 700 famiglie. Unfortunately, even when the father and children have legal rights to visits, mothers suffering from Malicious Mother Syndrome in cases of divorce continue to hinder the exercise of questo diritto.

Modello 2b: Libere conversazioni telefoniche con il padre
Nei casi di assenza fisica di un genitore il telefono svolge un ruolo importante nel mantenere il legame tra il figlio e il genitore non residente. Alcune madri affette dalla Sindrome della madre malevola nei casi di divorzio compiono una serie di atti volti ad impedire i rapporti telefonici.

Model 3A: Malicious Lying to the children
Given their developmental status, children in a divorce situation are quite vulnerable to conflict. When a parent decides to harm another by lying to children, there may be cases of malicious behavior such as:
A mother being told to divorce his young daughter that her husband was not his real father, even if the was.
A girl of 8 years was forced by her mother to give to the father of invoices you pay: the mother had falsely accused of not providing the support the family.
One mother told the children that their father had repeatedly beaten in the past, which is absolutely false.
These examples of malicious lying can be compared with the more subtle maneuvers typical of PAS, as the "virtual allegations" (Cartwright, 1993): the mother who causes the Parental Alienation Syndrome may hint that there was violence, while his mother affected by Malicious Mother Syndrome falsely claims that there was indeed violence.
Model 3B: Malicious Lying to others

Antisocial, "boderline, sadistic) but these behaviors may be observed even in women with Malicious Mother Syndrome who do not appear to meet official diagnostic Axis II disorder type. Model 4: Behavior is not caused by another disorder
In assessing the Malicious Mother Syndrome in a divorce, it is important to note that many of these case reports seem to have occurred in people who do not had received a diagnosis or previous treatment for mental disorders. In fact a mother who had an extremely malicious behavior toward her husband, when divorce has presented several witnesses, mental health specialists, who have argued that it suffers from some type of mental disorder.
the author's experience, for each mental disorder that can think of to explain some of this behavior, there is always an exceptional case. For example, in some cases it may be appropriate for a diagnosis of adjustment disorder: however, there is a case of a woman who, even 10 years after the divorce, she continued to deny the right of access. Other cases might suggest as a possible diagnosis personality disorder, but there is a case of a woman who has repeatedly violated the law by continuing attacks against her husband and against which high-level specialists have never found personality disorders. In some cases you might want to consider the diagnosis of intermittent explosive disorder, but some mothers anger appears intermittently.
Finally, the reader should realize that one side is not always diagnostic accuracy for certain psychiatric disorders is to be expected (eg. Personality disorders, see Turkat, 1990), the other the problem is made more severe in family law at times when they are involved in the process of mental health experts incompetent (Turkat, 1993). Clearly the relationship between the Malicious Mother Syndrome and other mental disorders is complex and requires significant investigation. Discussion

The previous description of the Malicious Mother Syndrome in a divorce raises a variety of clinical problems, legal and scientific issues. Under the clinical aspect
families in which the syndrome manifests itself are subject to serious episodes of stress and anxiety. However, there is no scientific clarity on how to cure the problem. This is particularly compromised by the fact that many of those who appear to meet proposed diagnostic deny that there is something wrong with them. Another

As regards the impact, from the name of the syndrome would appear that the malicious behavior is accelerated by the process of divorce. However, this is an empirical question. The malicious actions can be noted during the divorce process, but it is possible that the malicious behavior was pre-existing, albeit hidden. This hypothesis is supported by research on the pre-divorce parental conflict (Enos and Handal, 1986). In fact it may happen that there are cases of mental disorders that are not discovered until the stress of the divorce occurs.
Finally it should be noted that research began to appear on the functioning of the family after divorce. There are data on the role of parental conflict in relation to the behavior of children after divorce (eg. Parkiz and Frost, 1990, Furstenberg et al, 1997; Healy, Malley and Stewart, 1990; Kurdek, 1988), but have not yet appeared studies on the most extreme cases of Parental Alienation Syndrome and Syndrome madre malevola nei casi di divorzio.
La Sindrome della madre malevola nei casi di divorzio rappresenta un importante fenomeno sociale. Il disturbo coinvolge bambini, genitori, avvocati, giudici, tutori, operatori psichiatrici e altri. Finché il fenomeno non viene esplorato più accuratamente nella letteratura scientifica e clinica, i problemi causati da persone affette dalla Sindrome della madre malevola nei casi di divorzio continuerà ad affliggerci. Si spera che questo scritto stimoli la ricerca così da rendere possibile lo sviluppo di linee di orientamento per la gestione clinica e legale del problema.

La sindrome di Stoccolma è una condizione psicologica nella quale una persona vittima di un sequestro può manifestare sentimenti positivi nei confronti del suo sequestratore, arrivando ad instaurare con lui anche un forte legame affettivo, in alcuni casi fino all'innamoramento.
Prende il nome dalla capitale svedese , 1973 , a seguito di una rapina in banca , i dipendenti presi in ostaggio richiesero la clemenza alle sequestratori .
La sindrome di Stoccolma è talvolta citata in riferimento ad altre situazioni simili, quali le violenze sulle donne e gli abusi sui minori.

Origini del nome
La sindrome deve il suo nome alla rapina della "Kreditbanken" di Stoccolma nel 1973, in cui alcuni dipendenti della banca furono tenuti in ostaggio dai rapinatori per sei giorni. Le vittime provarono una forma di attaccamento emotivo ai loro sequestratori fino a giungere al punto di prendere le loro difese in seguito alla liberazione. Il termine fu coniato dal criminologo e psicologo Nils Bejerot , il quale aiutò la polizia durante la rapina. Fu usato per la prima volta durante una trasmissione televisiva.

Casi celebri
Patty Hearst aiutò il SLA durante una rapina in banca due mesi dopo il proprio rapimento
La ricca ereditiera Patty Hearst , dopo essere stata rapita dal Symbionese Liberation Army nel febbraio del 1974 , prese parte ad una rapina in banca insieme a due dei suoi rapitori due mesi dopo. Fu arrestata nel settembre del 1975 ma la sua difesa non riuscì a far valere la tesi della mancanza di colpevolezza a causa della manifestazione della sindrome di Stoccolma
Elizabeth Smart fu rapita e stuprata da un uomo affetto da malattie mentali che la considerava sua moglie: tra il 2002 ed il 2003 la Smart trascorse diversi mesi insieme al suo aguzzino senza alcuna costrizione fisica.

Casi dubbi
Natascha Kampusch ha vissuto segregata col suo rapitore ( Wolfgang Priklopil ) dal marzo 1998 al 23 agosto 2006 , giorno in cui è scappata. Ha testimoniato di avere avuto più volte la possibilità di scappare, ma ha preferito restare col rapitore. Il motivo della fuga, infatti, non è stato un desiderio di libertà, ma un litigio col rapitore stesso. Agli investigatori e agli psicologi che si prendono cura di lei ha testimoniato dicendo che non si sentiva privata di niente e che è dispiaciuta della morte del suo rapitore (che si è suicidato dopo che era scappata). La ragazza, però, intervistata dalla televisione austriaca il 6 settembre 2006 , ha smentito le voci sulla sua presunta "sindrome di Stoccolma", aggiungendo di non aver mai rinunciato alla fuga. Ha solo manifestato pietà per il rapitore suicida e per la sua famiglia.
